Ninosky Successfully Defends Hospital in Negligence Action in Philadelphia

John Ninosky recently successfully defended a large Philadelphia specialty hospital and its surgery center in the Court of Common Pleas of Philadelphia County. The Plaintiff was seeking $1 million in damages, alleging a physician at the surgery center negligently performed a ptosis surgery, a procedure performed to correct drooping eyelids which impair vision. The Plaintiff also alleged the hospital and the surgery center were negligent in failing to follow their by-laws in providing credentials to the physician. After a seven day trial, the jury returned a verdict in favor of all Defendants. The jury specifically found no negligence on the part of the hospital or the surgery center.
