Plaintiff filed a complaint alleging negligence against Defendant arising out of a motor vehicle accident. Defendant, represented by Kristin E. Jaquis, Esquire, of Johnson Duffie, filed preliminary objections raising the single issue of improper service after Plaintiff attempted service via a process server instead of a sheriff. Oral argument was scheduled and Plaintiff failed to appear. Accordingly, the preliminary objections were sustained and the Complaint was dismissed with prejudice. Plaintiff filed a Motion to Vacate and/or Reconsider the Court’s Order. After the Court heard brief argument on the Motion to Vacate, which was granted, the Court moved to argument on the original Preliminary Objections. This Court then sustained Defendant’s Preliminary Objections, again, and dismissed Plaintiff’s Complaint noting that Plaintiff failed to effect service in accordance with the Rules. After reviewing the errors complained of on appeal, the Court found no errors and asked the Superior Court to affirm.
